# Halton Conservation Authority Permit Burlington, ON | Regulated Lot Approvals

Last updated: October 13, 2026

Lots touching Grindstone Creek, Rambo Creek, Shoreacres Creek or the Lake Ontario shoreline fall under Conservation Halton regulation, which governs grading, top-of-bank setbacks, tree protection and stormwater. Buyers who skip the check can find 30 percent of a lot undevelopable.

We flag these constraints in the lot evaluation, commission the studies the authority asks for and sequence the permit with your building permit, so a regulated lot does not pause your project for 12 to 20 weeks of redesign. Regulated-lot permits typically cost $5K to $18K, managed in-house.

Custom Home Builder Burlington

provides Conservation Halton permits, ravine-lot approvals, shoreline hazard mapping and regulated-lot design throughout Burlington and Halton Region, backed by 22+ years combined Halton design-build experience. This page explains what a Conservation Halton permit covers, how regulated limits are set, which studies may be needed and how we keep a regulated lot from stalling your project.

## What Is a Conservation Halton Permit?

**Conservation Halton** is the conservation authority for most of Burlington and Halton Region. Under the **Conservation Authorities Act**, it regulates development in areas affected by natural hazards: river and stream valleys, floodplains, wetlands, unstable slopes and the **Lake Ontario shoreline**. If your lot is in a **regulated area**, building a house, placing fill, changing grades or even adding a large deck there needs a Conservation Halton permit.

In Burlington, the regulated areas that most often affect custom homes are around **Grindstone Creek** in Aldershot and the west end, **Rambo Creek** through central Burlington, **Shoreacres Creek** in the east and the Lake Ontario shoreline from Aldershot to Burlington Lakeshore. Ravine lots in Tyandaga and parts of Headon Forest are also commonly regulated.

## Why Regulated Lots Catch Buyers Out

Many homeowners buy a creek or ravine lot before checking the regulation, then discover that **30 percent of the lot is undevelopable**. The project pauses **12 to 20 weeks** for redesign, and sometimes the house they planned simply does not fit. The lot looked deep on the survey, but the buildable depth ends at the hazard limit.

That is the second of the three traps in our

problem overview

[/#why-builds-stall →](/#why-builds-stall)

, and it is the reason our written lot evaluation screens every lot for regulated areas before any design work starts.

## How Regulated Limits Are Set

### Valley and ravine lots

For a ravine, the key line is the **stable top of bank**. Where the slope is steep or soils are weak, the stable top of bank can sit well back from the visible edge. Conservation Halton typically adds an **erosion hazard allowance** and a setback from the hazard. On many lots, a geotechnical **slope stability study** is needed to confirm the line.

### Floodplain lots

Near creeks, the **floodplain** sets where habitable space can go. A floodline analysis may be needed if mapping is not detailed enough for your site.

### Lake Ontario shoreline

On the lakefront, the shoreline hazard combines flooding (including the 100-year flood level), erosion and wave uprush allowances. The house, lower level and openings must sit outside or above these limits.

> **A practical example**
>
> Chloe S. in Aldershot had been told by two builders that her house would not fit on her Grindstone Creek lot. Our lot evaluation measured the real top-of-bank setback, the design shifted 4 metres, and Conservation Halton approved it on the first submission.

## Studies Conservation Halton May Request

| Study | When it is needed | What it confirms |
| --- | --- | --- |
| Slope stability study | Ravine and valley lots with steep or high slopes | Stable top of bank and setback |
| Erosion hazard assessment | Creek-side and shoreline lots | Erosion allowance |
| Floodline analysis | Lots near watercourses without detailed mapping | Flood elevation and limit |
| Grading and drainage plan | Most regulated lots | How water moves on and off the lot |
| Tree inventory and protection plan | Wooded valley lots | Trees to keep and protection zones |
| Stormwater management brief | Larger impervious areas | Runoff control toward the valley |

We commission only the studies your lot needs, and we start them during design so they are ready with the application.

## How a Conservation Permit Fits With Other Approvals

A regulated lot often involves several approvals at once. The **building permit** from Burlington Building Division under **OBC Part 9** generally cannot be issued until the conservation permit is in place. Some lots, particularly in Tyandaga and north Burlington, also fall within the **Niagara Escarpment Plan**, which needs a **Niagara Escarpment Commission** development permit. **Zoning By-law 2020** still applies to height, setbacks and coverage, and the **Halton Region Official Plan** sets the broader policy framework for natural heritage and hazards.

Our in-house expeditor manages all of these on one desk, so they run in parallel. See our

building permit application service

[/building-permit-application/ →](/building-permit-application/)

 for the full permit path.

## Costs and Timing

Our regulated-lot permit service typically costs **$5K to $18K**, depending on the studies required and the complexity of the site. That covers screening, study coordination, the application and responses to agency comments. Consultant study fees and agency fees are identified in the lot evaluation.

When screened early, the conservation permit usually runs inside our **14 to 18 week** permit window.

## Designing a Great Home on a Regulated Lot

A regulated lot is not a second-best lot. Some of our favourite homes sit on them: the Aldershot modern that turns its glass toward the Grindstone Creek valley, the Tyandaga escarpment farmhouse with a walkout following the natural grades, and the Downtown waterfront home that faces Lake Ontario from above the flood line. The trick is designing from the confirmed limit, not discovering it later. Start with a

Why Us

## Why Choose Custom Home Builder Burlington for Conservation Permits?

A calm, exacting process backed by numbers, by-laws and named projects.

### Screened before you pay for drawings

Regulated limits are flagged in the lot evaluation, so design starts from the real buildable area.

### Only the studies you need

Slope, erosion and floodline studies are commissioned when the lot calls for them, not by default.

### Run in parallel

The conservation permit is sequenced with the building and NEC permits so it does not hold up excavation.

### First-submission approvals

Chloe S. in Aldershot had a creek-lot design approved on first submission after the footprint moved 4 metres.

### Hundreds of Halton lots assessed

Ravine, escarpment-protected and Lake Ontario waterfront lots since 2003.

### Designs that use the slope

Walkouts and valley-facing glazing turn a regulated lot into a feature, not a compromise.

Client Experience

## What Clients Say About Our Conservation Permits Work

Every quote below is from a client who signed a fixed-price contract with us. We do not display a star rating because we have not imported third-party reviews.

> "Our lot backs onto Grindstone Creek and two other builders told us the house we wanted would not fit. The lot evaluation measured the real top-of-bank setback, the design was shifted 4 metres, and Conservation Halton approved it on the first submission."

**Chloe S.**, Aldershot$1,570K modern

> "We needed to move before September for the kids' school. The schedule was set around that date in the contract, and we got the keys in mid-August. The heat pump and ERV keep the house even all year, and our first winter of utility bills was a fraction of our old semi in Mississauga. Blower-door results were shared with us at every test."

**Daniel and Mei L.**, Alton Village$1,460K Net Zero

> "We sold in Leaside and bought a South Oakville lot. The Town of Oakville site plan review and tree protection plan were handled in-house, and the project manager sent photos every Friday. Ten percent at contract, five draws, and the final number matched the January quote."

How do I know if my property is in a Conservation Halton regulated area?

Conservation Halton publishes regulation mapping that shows approximate regulated areas around watercourses, valleys, wetlands and the Lake Ontario shoreline. The mapping is a screening tool, so the actual regulated limit on your lot depends on site conditions such as the top of bank and slope. We check the mapping and walk the lot during the lot evaluation, and if your lot is affected, we tell you which studies will be needed to confirm the limit.

How close to a ravine can I build in Burlington?

It depends on the stable top of bank, which is set by slope geometry and soil conditions, plus an erosion allowance and any required setback from the hazard. On many ravine lots, a geotechnical slope stability study is needed to confirm where that line sits. Once it is confirmed, we design the footprint, decks and grading outside it.

Do I need a Conservation Halton permit and a building permit?

If your work is inside a regulated area, yes. The Conservation Halton permit addresses natural hazards such as flooding, erosion and unstable slopes, while the building permit addresses the Ontario Building Code and applicable law. The building permit generally cannot be issued until the conservation permit is in place, which is why we sequence them together.

How long does a Conservation Halton permit take?

When the regulated area is screened during the lot evaluation and studies are commissioned early, the conservation permit usually runs inside our 14 to 18 week permit window. Lots where the constraint is discovered late can lose 12 to 20 weeks to redesign.

Can a regulated lot still fit a large custom home?

Often, yes. Many regulated lots still have generous buildable area once the limit is confirmed. Designs that move the house forward, use a walkout lower level and orient glazing toward the valley can deliver a large home with better views than a flat lot.

What is the Lake Ontario shoreline hazard?

On lakefront parcels, the shoreline hazard combines flooding, erosion and dynamic beach or wave uprush allowances. Habitable space and openings must sit outside or above these limits. We map them before design on every waterfront lot.

What studies might Conservation Halton ask for?

Depending on the lot, the authority may request a slope stability study, an erosion hazard assessment, a floodline analysis, a grading and drainage plan, a tree inventory and protection plan or a stormwater management brief. We commission only what your lot needs.

What happens during construction on a regulated lot?

Permit conditions usually require erosion and sediment control, such as silt fencing, plus tree protection and limits on where materials can be stored. Your project manager keeps these in place and maintained until the site is stabilized.
